Accidents Caused by an Untraced or Uninsured Driver

If you have been unfortunate enough to have been involved in a road traffic accident, either as a driver, passenger, cyclist, motorcyclist or pedestrian, where the person responsible is either uninsured or has fled the scene (hit and run), you may think you will be unable to pursue a claim for personal injury. Thankfully, this isn’t true.

The Motor Insuers’ Bureau (MIB) was established in 1946 and ensures that victims of road traffic accidents in this situation are still able to recover compensation, and certain other losses.

Sometimes, the vehicle appears to be insured, but the driver is not insured to drive it. In this situation, claims are often submitted to the insurer first and then can re-directed to the MIB if the insurer refuses to deal with the claim.

If the vehicle involved has fled the scene, then the matter should be reported to the police straight away. If they are unable to trace the vehicle and driver responsible, then your only option may be to make a claim to the MIB.
