In many European jurisdictions, the principle of strict liability favours pedestrians, automatically attributing fault to the driver in the event of a collision. This legal stance significantly differs from the UK’s approach, where pedestrian accidents require the injured party to establish fault much like any road traffic dispute. Despite this, UK courts have historically recognised the vulnerability of pedestrians, often ruling in ways that extend additional safeguards to them and assign a heavier burden of care upon drivers.
